LEGAL NOTICE - BOARD OF ISLAND COUNTY COMMISSIONERS
GMA Public Hearing 

NOTICE IS HEREBY GIVEN that the Board of Island County Commissioners will hold a public hearing on April 26, 2010 at 2:15 p.m. to review Ordinance C-31-10 [PLG-001-10] in the matter of adopting an Interim Official Control that regulates the use of property within the Freeland Non-Municipal Urban Growth Area. The proposed ordinance adopts the Freeland NMUGA interim development regulations addressing the following:

  1. Eliminates the potential for new uses to be established that are classified as non-conforming under the Land Use Element of the Freeland Sub Area Plan;
  2. Allows interim development only after it is demonstrated that the activity will not preclude future urban growth, uses, and infrastructure; and
  3. Goes into effect immediately and shall remain in effect for a period of six months, or as soon as permanent rules are adopted, whichever is earlier.

ALL PERSONS or authorized representatives interested in or desiring to speak on the above matters regarding the Island County Comprehensive Plan should be present at the time and place above specified, or should file written comments with Island County Planning and Community Development before the above date. THE GROWTH MANAGEMENT ACT

Amendments to site requirements and regulations for mini storage facilities in the Rural Zone

On January 4, 2010, the Board of Island County Commissioners, through Ordinance

C-157-09 [PLG-025-09], adopted modifications to the site requirements and regulations for personal storage facilities in the Rural (R) Zone and renamed personal storage as mini storage. This Ordinance was adopted pursuant to the Growth Management Act, Chapter 36.70A RCW and more specifically RCW 36.70A.040

The Board of County Commissioners considered the recommendation made by the Planning Commission and further held public hearings on December 14, 2009 and January 4, 2010.

In 1998, Island County completed environmental review under Chapter 43.21C RCW, SEPA, on the Comprehensive Plan and Development Regulations.  Pursuant to WAC 197-11-600, the County SEPA Official has determined these amendments do not have a probable significant adverse impact on the environment. A SEPA Mitigated Threshold Determination of Non-Significance (MDNS) was issued on May 28, 2009.

Any appeal of the above action alleging non-compliance with the Growth Management Act and SEPA must be commenced by the filing of a petition that includes a detailed statement of issues presented for resolution by the Board.  The petition must be filed no later than March 15, 2010, or 60 days after the date of publication in the legal newspaper for Island County, with the following:

OPS 358/08  Applicant James Lukehart requests to have 15.3 acres of his 20 acre North Camano property reclassified from current use to Open Timber tax classification. The proposal includes parcels:  R33219-050-3340 & R33219-017-3350. 

OPS 366/08  Applicant Michael Jones requests to have 17.3 acres of their 18.3 acre North Whidbey property reclassified from current use to the Open Timber tax classification. The proposal includes parcels: R23322-240-1000 and R23322-303-1000.

In the matter of revisions to Chapter 17.03 ICC, Island County Zoning Code, regarding site requirements for mini storage in the Rural Zone and renaming personal storage as mini storage.

NOTICE OF PUBLIC HEARING

              On December 14, 2009 at 10:20 a.m., the Board of Island County Commissioners will hold public hearings at the Island County Annex Building, Commissioner’s Hearing Room, at 1 North East Sixth Street, Coupeville, Washington, to consider amendment of the building permit fee schedule and the land use permit fee schedule.

Island County’s fees have not kept up with inflation. In order for building permit fees and the land use permit fees to be aligned with the actual costs of providing the service and commensurate with surrounding counties, the Board will consider amending these fees.

Copies of the proposed amendments of the Planning & Community Development building permit fee schedule and land use fee schedule are available at the Planning & Community Development Department, 1 NE 6th Street, Coupeville or by contacting Paula Bradshaw at (360) 678-7802 or paulab@co.island.wa.us.  Interested persons may appear at the public hearing and give testimony for or against the amendments.  Persons requiring auxiliary aids/services should call Island County Human Resources at 679-7919, 629-4522, Ext. 7919, or 321-5111, Ext 7919 (use whichever number is applicable for the area) at least 24 hours prior to the meeting.

Amendments to the Island County Zoning Code 17.03

November 16, 2009 the Board of Island County Commissioners, through Ordinance

C-130-09 [PLG-020-09], adopted the Planning Commission’s recommendation to expand the allowance of Essential Public Facilities (EPF)s into Rural Agriculture and Rural Forest Zones.

In 1998, Island County completed environmental review under Chapter 43.21C RCW, SEPA, on its Comprehensive Plan and Development Regulations.  Pursuant to WAC 197-11-600, the County SEPA Official has determined that the proposed changes to Chapter 17.03 ICC, relating to establishing these standards, are not likely to have significant adverse environmental impacts beyond those that were considered in the EIS & other supporting environmental documents prepared for the 1998 Comprehensive Plan & Development Regulations.

Any appeal of the above action alleging non-compliance with the Growth Management Act & SEPA must be commenced by the filing of a petition that includes a detailed statement of issues presented for resolution by the Board.  The petition must be filed no later than January 20, 2010, or 60 days after the date of publication in the legal newspaper for Island County, with the following:   (Western Washington Growth Management Hearings Board, 905 - 24th Way SW, Suite B-2, P.O. NOTICE IS HEREBY GIVEN that the Board of Island County Commissioners will hold public hearings in the Commissioners Hearing Room, Coupeville, Washington, 1 NE 6th Street, on November 2, 2009 at 10:15 a.m., to consider the following two ordinances.

C-120-09 [PLG-021-09], in the matter of adopting an Interim Official Control that regulates the use of property within the Freeland Municipal Urban Growth Area. The proposed ordinance reauthorizes the Freeland NMUGA interim development regulations addressing the following:

  1. Eliminates the potential for new uses to be established that are classified as non-conforming under the Freeland Sub Area Plan;
  2. Allows interim development only after it is demonstrated that the activity will not preclude future urban growth, uses, and infrastructure; and
  3. Goes into effect immediately and shall remain in effect for a period of six months, or as soon as permanent rules are adopted, whichever is earlier.

 C-121-09 [PLG-016-09], in the matter of amending Map # 219 of the Island County Zoning Atlas to rezone six parcels from Rural (R) to Light Manufacturing (LM) and correct the Urban Growth Area boundary.  The proposed ordinance brings the Island County Zoning Atlas into consistency with the Island County Comprehensive Plan.
